Terms of Service
Effective Date: 05/01/2025

Welcome to BodyTime. These Terms of Service ("Terms") govern your access to and use of BodyTime’s telehealth services, including subscription plans, virtual health coaching, and medical care provided by licensed healthcare professionals. By accessing or using BodyTime’s services, you agree to be bound by these Terms.

1. Overview and Acceptance of Terms
By registering for or using BodyTime, you agree to these Terms and our Privacy Policy and HIPAA Notice. If you do not agree, please do not use our services. We may update these Terms at any time, and continued use of the platform constitutes acceptance of those changes.

2. Eligibility
You must be at least 18 years of age and located in a U.S. state where BodyTime operates and where your chosen provider is licensed. You represent that all registration and medical information you submit is truthful and accurate.

3. Description of Services
BodyTime provides virtual healthcare and coaching services through licensed Physician Assistants (PAs) and Nurse Practitioners (NPs) who are supervised by a collaborating physician in accordance with federal and state regulations. Our services include:

- At-home lab testing 
- Review of medical and health history 
- Personalized health coaching 
- Prescriptions for select medications, when medically appropriate 
- Access to a secure patient portal 
- Scheduled video visits with a chosen provider

BodyTime is a medical service and establishes a provider/patient relationship. However, BodyTime is not a replacement for your primary care physician. Clients are encouraged to maintain a relationship with a primary care provider for comprehensive medical care.

BodyTime does not provide emergency care. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

4. Medical Providers
All medical services are provided by licensed healthcare professionals. BodyTime's providers are licensed in specific states, and you may only choose a provider who is licensed in the state where you are located. Providers function both as healthcare practitioners and health coaches under their state licensure.

5. Prescriptions
Medications may be prescribed by BodyTime’s PAs or NPs based on their professional medical judgment. Medications are not guaranteed and will only be prescribed when clinically appropriate and legal in your state.

6. Subscriptions, Billing, and Commitments

a. Monthly Subscription
- Clients may choose a monthly billing option.
- Clients must commit to a minimum of 3 months, even though billing is processed monthly.
- After the initial 3-month commitment, the subscription continues month-to-month unless canceled.

b. Yearly Subscription
- Clients may also choose an annual plan, which renews automatically unless canceled.

All subscription plans will auto-renew unless you cancel according to the process outlined below. No refunds will be issued for unused time.

7. Coach/Provider Selection and Appointment Policies
- Clients may choose a licensed provider available in their state.
- Clients may change providers up to two (2) times per calendar year.
- If you miss a scheduled meeting with your provider without canceling or rescheduling at least 24 hours in advance, the session is forfeited and will not be rescheduled or refunded.
- You may cancel or reschedule a session by emailing your provider or through the BodyTime platform at least 24 hours in advance.

8. Payment Terms
- You agree to pay all fees associated with your subscription.
- Payments are processed via our third-party payment processor.
- Failure to pay may result in suspension or termination of your account.

9. Privacy and HIPAA Compliance
We take your privacy seriously. BodyTime complies with all applicable HIPAA regulations. Our full Privacy Policy and HIPAA Notice are posted on our website and must be reviewed and signed before receiving services.

10. Technology and Access
You must have internet access and a compatible device to use BodyTime’s services. We are not responsible for any issues resulting from technical problems or your internet connectivity.

11. User Conduct
You agree not to misuse BodyTime’s services, including:
- Providing false or misleading information
- Harassing or abusing staff
- Violating any applicable laws

12. Intellectual Property
All content on BodyTime’s website and platform, including branding, design, and materials, is owned by or licensed to BodyTime and may not be used or reproduced without written permission.

13. Limitation of Liability
To the maximum extent permitted by law, BodyTime is not liable for any indirect, incidental, or consequential damages. Our total liability will not exceed the amount paid by you in the past 12 months.

14. Indemnification
You agree to indemnify and hold BodyTime, its affiliates, and providers harmless from any claims or liabilities arising from your misuse of the service, breach of these Terms, or violation of applicable law.

15. Dispute Resolution
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved through binding arbitration in Travis County, Texas. By agreeing to these Terms, you waive any right to participate in class actions.

16. Termination
You may terminate your subscription:
- By emailing your provider or concierge, or
- By informing your provider during one of your quarterly visits.

Termination takes effect at the end of your current billing period. Your data will be securely stored in a HIPAA-compliant manner, and you will retain access to your records through our secure patient portal after cancellation. You may resume services at any time by re-subscribing.
